Meth Testing in Kapiti and the Wellington Region

It has been described as a ticking time bomb. NZ’s most dangerous drug is often an invisible one and it is said that Methamphetamine (or P) contamination has now become a MAJOR hidden health issue. It is not simply pop-up meth labs (where cooking has occurred) that is the worry. Meth smoking itself will coat any room and contents with its toxic residues.

If the property is untenanted, and the landlord or property manager suspects that methamphetamine (‘P’) has been used or manufactured on the property, then the landlord or property management business should take responsibility for ensuring the property is expertly tested and cleaned before any workers or tenants are allowed back into the property.

So meth is far from yesterday’s news. It is the impact both in terms of health and the financial burden, which is still emerging. Police statistics show 77% of meth labs are found in residential properties.

Under new Health & Safety Legislation, Landlords and Property Managers are not only responsible for tenants health & wellbeing, but must also protect the health of contractors on a property, if there is a chance methamphetamine has been used or manufactured there. If landlords rent out a contaminated property, they are breaching their obligations under the Residential Tenancies Act and other legislation such as the Building Act and the Health Act.  A recent Tenancy Tribunal decision ordered a Tuakau Landlord to pay more than $7500 to his former tenants for unknowingly renting them a meth-contaminated house.

Affected parties include Landlords; owners; Property Managers; hotels; motels; batches – even motor vehicles! We now find Banks, Real Estate Companies and Mortgage Brokers increasingly demanding professional testing prior to final sale and purchase agreement.
